BY USING THE PIPPIN MOBILE APPLICATION ("APP") OR SERVICES ("SERVICES") PROVIDED BY PIPPIN ("WE," "US," OR "OUR"), YOU AGREE TO THE FOLLOWING TERMS AND CONDITIONS OF USE. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APP OR SERVICES.

The content, information, opinions, and suggestions contained in the App and Services are not meant as, and are not a substitute for, professional advice from or consultation with a medical or health professional, nutritionist, or expert in feeding and eating ("Health Care Providers"). The content, information, opinions, and suggestions offered have been created with typically developing babies and children in mind. The information here is generalized for a broad audience. Your child is an individual and may have needs or considerations beyond generally accepted practices.

If your child has underlying medical or developmental differences (including but not limited to: prematurity, developmental delay, hypotonia, airway differences, chromosomal abnormalities, craniofacial anomalies, gastrointestinal differences, cardiopulmonary disease, or neurological differences), we strongly recommend and encourage you to discuss their feeding plan and when and how to start solids and finger food with your child's Health Care Providers.

Pippin is not engaged in rendering professional advice, whether medical or otherwise, to individual users or their children or families. No content in this App, regardless of date, should ever be used as a substitute for direct medical advice from your Health Care Providers. By accessing the content in the App, you acknowledge and agree that you are accepting responsibility for your child's health and well-being.

TO THE EXTENT A USER USES AND CONSIDERS CONTENT, INFORMATION, OPINIONS, AND SUGGESTIONS OBTAINED IN THE APP OR SERVICES, THE USER DOES SO AT HIS OR HER OWN RISK, AND PIPPIN AND ITS OWNERS, MEMBERS AND EMPLOYEES ARE NOT LIABLE OR RESPONSIBLE FOR ANY LOSS, INJURY, OR DAMAGE ARISING FROM ANY CONTENT, INFORMATION, OPINION, OR SUGGESTION FOUND IN THE APP OR SERVICES. ALWAYS SEEK THE ADVICE OF YOUR HEALTH CARE PROVIDERS WITH ANY QUESTIONS YOU MAY HAVE REGARDING YOUR CHILD'S DEVELOPMENT AND CAPACITY FOR STARTING SOLID FOODS.

1. Agreement to Terms

Welcome to Pippin. These Terms of Service ("Terms," "Terms of Service," or "Agreement") constitute a legally binding agreement between you ("you," "your," or "User") and Pippin governing your access to and use of the Pippin mobile application, website, and services (collectively, the "Services").

BY ACCESSING OR USING THE SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SERVICES.

If you are using the Services on behalf of an organization or entity, you represent and warrant that you have the authority to bind that organization to these Terms, and your agreement to these Terms will be treated as the agreement of the organization.

1.1 Definitions

In these Terms:

  • "Content" means any information, text, graphics, photos, or other materials uploaded, posted, or otherwise transmitted via the Services.
  • "Personal Data" has the meaning given in our Privacy Policy.
  • "Services" means the Pippin mobile application, website, and any related services we provide.
  • "Subscription" means a paid plan that provides access to premium features.
  • "User Content" means any Content you submit or upload to the Services.
  • "Baby Profile" means the collection of information you create about a child, including feeding records, photos, and health observations.

2. Eligibility and Account Requirements

2.1 Age Requirements

You must be at least 18 years old to create an account and use Pippin. By using the Services, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this Agreement.

Pippin is designed for use by parents, legal guardians, and authorized caregivers. It is NOT intended for direct use by children under 13 years of age.

2.2 Account Registration

To use certain features of Pippin, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information to keep it accurate and current
  • Maintain the security and confidentiality of your password and account credentials
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account
  • Use only one account (no multiple or duplicate accounts)

2.3 Parental/Guardian Responsibility

By creating baby profiles and entering information about a child, you represent and warrant that you are the parent or legal guardian of that child and have the legal authority to provide consent for the collection and processing of the child's information as described in our Privacy Policy.

3. Description of Service

Pippin is a digital platform that provides tools for parents and caregivers to track and manage information related to baby food introduction, including:

  • Logging foods introduced to babies and tracking acceptance status
  • Recording feeding observations, reactions, and allergies
  • Uploading and storing photos of meals
  • Collaborating with other caregivers on baby profiles
  • Generating and exporting feeding reports
  • Accessing educational content about baby nutrition and food introduction

The Services may be offered in both free and paid (subscription) versions. Certain features may require a paid subscription.

4. Acceptable Use Policy

4.1 Permitted Uses

You agree to use the Services only for lawful purposes and in accordance with these Terms. You may:

  • Create baby profiles for children for whom you are a parent/legal guardian or authorized caregiver
  • Track feeding information and observations for personal, non-commercial use
  • Invite other authorized caregivers to collaborate on baby profiles
  • Export and share reports with healthcare providers
  • Use the app to organize and manage feeding-related information

4.2 Prohibited Uses

You agree NOT to:

  • Use the Services for any illegal, harmful, or fraudulent purpose
  • Create profiles for children without proper parental/guardian authorization
  • Impersonate any person or entity or falsely state your relationship with any person or entity
  • Upload content that is offensive, defamatory, obscene, or violates third-party rights
  • Upload viruses, malware, or other malicious code
  • Attempt to gain unauthorized access to the Services, other user accounts, or computer systems
  • Reverse engineer, decompile, or disassemble any part of the Services
  • Use automated scripts, bots, or scrapers to access the Services
  • Interfere with or disrupt the Services or servers/networks connected to the Services
  • Sell, rent, lease, or sublicense your access to the Services
  • Use the Services for commercial purposes without our written permission
  • Remove, obscure, or alter any copyright, trademark, or other proprietary rights notices
  • Collect or store personal data about other users without their consent

4.3 Consequences of Violation

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without notice or refund, and we may report violations to law enforcement authorities if appropriate.

5. Health and Medical Disclaimer

5.1 NOT MEDICAL ADVICE: Pippin is a tracking and organizational tool only. ALL CONTENT, INFORMATION, AND FEATURES PROVIDED BY PIPPIN (INCLUDING BUT NOT LIMITED TO FOOD SUGGESTIONS, AGE RECOMMENDATIONS, ALLERGEN INFORMATION, NUTRITIONAL DATA, AND EDUCATIONAL CONTENT) ARE FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY.

PIPPIN DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. IT IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE FROM YOUR PEDIATRICIAN, ALLERGIST, NUTRITIONIST, OR OTHER QUALIFIED HEALTHCARE PROVIDER.

5.2 NO DOCTOR-PATIENT RELATIONSHIP: Use of Pippin does not create a doctor-patient or healthcare provider-patient relationship between you and Pippin or any of its developers, employees, or affiliates.

5.3 ALWAYS CONSULT YOUR DOCTOR: You should ALWAYS consult with your baby's pediatrician or qualified healthcare provider before:

  • Starting solids or introducing new foods to your baby
  • Introducing common allergens (eggs, peanuts, tree nuts, dairy, soy, wheat, fish, shellfish)
  • Making decisions about your baby's nutrition or feeding schedule
  • Interpreting any reactions or symptoms your baby experiences
  • Taking any action based on information provided by Pippin

5.4 NO GUARANTEES OF ACCURACY: While we make reasonable efforts to provide accurate and up-to-date information, we DO NOT GUARANTEE the accuracy, completeness, reliability, or timeliness of any content in Pippin. Nutritional information, allergen data, and feeding guidelines may be incomplete, incorrect, or outdated.

5.5 EMERGENCY SITUATIONS: Pippin is NOT intended for use in emergency situations. If you believe your baby is experiencing an allergic reaction, choking, or any medical emergency, CALL EMERGENCY SERVICES IMMEDIATELY (192 in Brazil / 911 in US / your local emergency number) - DO NOT RELY ON PIPPIN.

5.6 YOUR SOLE RESPONSIBILITY: YOU ARE SOLELY AND ENTIRELY RESPONSIBLE FOR ALL DECISIONS REGARDING YOUR BABY'S FEEDING, NUTRITION, AND HEALTH. You acknowledge that you make all feeding decisions at your own risk.

5.7 NO LIABILITY FOR HEALTH OUTCOMES: PIPPIN SHALL NOT BE LIABLE FOR ANY INJURY, ALLERGIC REACTION, CHOKING INCIDENT, ILLNESS, DEATH, OR OTHER ADVERSE HEALTH OUTCOME RESULTING FROM YOUR USE OF THE SERVICES OR RELIANCE ON INFORMATION PROVIDED BY PIPPIN.

6. Intellectual Property Rights

6.1 Our Intellectual Property

All content, features, and functionality of the Services (including but not limited to software, code, text, graphics, logos, icons, images, audio clips, video clips, data compilations, page layout, underlying code, and software) are the exclusive property of Pippin or its licensors and are protected by Brazilian and international copyright, trademark, patent, trade secret, and other intellectual property laws.

"Pippin," the Pippin logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Pippin. You may not use these trademarks without our prior written permission.

6.2 Limited License to Use Services

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:

  • Access and use the Services for your personal, non-commercial use
  • Download and install the mobile application on devices you own or control

This license does NOT include any right to:

  • Reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, or transmit any of the Services
  • Sell, rent, lease, sublicense, or otherwise transfer rights to the Services
  • Copy, modify, or create derivative works of the software
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive source code from the Services
  • Remove, obscure, or alter any proprietary rights notices

6.3 Your Content

You retain ownership of content you upload to Pippin (photos, notes, observations). However, by uploading content, you grant Pippin a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, store, modify, and transmit your content solely to provide the Services to you and other authorized users of your baby profiles.

This license terminates when you delete the content or your account (subject to backup retention periods described in our Privacy Policy).

6.4 Feedback

If you provide feedback, suggestions, or ideas about Pippin ("Feedback"), you grant us an unlimited, irrevocable, perpetual, sublicensable, transferable, royalty-free license to use such Feedback for any purpose without compensation or attribution to you.

6.5 Copyright Infringement Claims

If you believe content in Pippin violates your copyright, please contact us at [email protected] with:

  • Description of the copyrighted work you claim has been infringed
  • Description of where the infringing material is located in the Services
  • Your contact information (address, telephone, email)
  • A statement that you have a good faith belief that use of the material is not authorized
  • A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner
  • Your physical or electronic signature

Repeat Infringer Policy: In accordance with applicable law, we will terminate, in appropriate circumstances, users who are repeat infringers of copyrighted materials.

7. Subscriptions and Payments

7.1 Subscription Plans

Pippin may offer free and paid subscription plans. Features, pricing, and availability of subscription plans are subject to change at any time.

7.2 Payment Processing

All payments and subscriptions are processed through:

  • Apple App Store (for iOS users)
  • Google Play Store (for Android users)
  • RevenueCat (subscription management)

Billing, payment, refunds, and subscription management are subject to the terms and conditions of the respective platform (Apple or Google). We do not process payments directly and do not have access to your payment information.

7.3 Automatic Renewal

Subscriptions automatically renew at the end of each subscription period (monthly or annual) unless you cancel before the renewal date. You will be charged the then-current subscription price.

To cancel, you must manage your subscription through your Apple App Store or Google Play Store account settings. Canceling through the app store will stop future charges but does not entitle you to a refund for the current subscription period.

7.4 Price Changes

We reserve the right to change subscription prices at any time. Price changes will apply to new subscribers immediately and to existing subscribers upon their next renewal after 30 days' notice.

7.5 Refund Policy

All sales are final. Refunds are subject to the refund policies of Apple App Store or Google Play Store. We do not offer refunds directly.

Note: Under Brazilian Consumer Protection Law (CDC), you may have certain rights to cancel purchases within 7 days. To exercise these rights, contact the app store (Apple or Google) where you made the purchase.

7.6 Free Trial

If we offer a free trial, you must cancel before the trial period ends to avoid being charged. Cancellation must be done through the app store. We are not responsible for charges incurred if you fail to cancel before the trial ends.

8. Privacy and Data Protection

Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy.

Please review our Privacy Policy to understand how we collect, use, and protect your data.

Key points:

  • We collect and process personal data in accordance with Brazilian LGPD and EU GDPR
  • You have rights to access, correct, and delete your data
  • Information about children is considered sensitive data and requires parental consent
  • We implement security measures but cannot guarantee absolute security

9. User Responsibilities and Conduct

9.1 Account Security

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or security breach
  • Using a strong password and enabling two-factor authentication if available

9.2 Caregiver Access Management

You are solely responsible for managing who has access to your baby's profiles. When you invite caregivers, they will have access to all data for that baby profile. You should only invite trusted individuals and remove access promptly when no longer appropriate (e.g., when a nanny is no longer employed).

9.3 Data Accuracy

You are responsible for the accuracy of all information you enter into Pippin. We are not liable for any consequences arising from inaccurate or incomplete data you provide.

9.4 Backup of Important Data

IMPORTANT: You are solely responsible for maintaining backup copies of any important data stored in Pippin. We recommend regularly exporting your data using the app's export feature.

While we implement backup systems, we do not guarantee that your data will never be lost or corrupted. We are not liable for any data loss.

10. Termination and Suspension

10.1 Your Right to Terminate

You may terminate your account at any time by:

Account deletion is permanent and cannot be undone. All your data will be deleted in accordance with our Privacy Policy. Active subscriptions will not be refunded upon voluntary account deletion.

10.2 Our Right to Terminate or Suspend

We reserve the right to suspend or terminate your account and access to the Services, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms or our Acceptable Use Policy
  • Fraudulent, illegal, or harmful activity
  • Non-payment of subscription fees
  • Upon your request
  • Discontinuation or material modification of the Services
  • Unexpected technical or security issues
  • Compliance with legal requirements or requests from law enforcement

We are not liable for any damages or losses resulting from account suspension or termination.

10.3 Effect of Termination

Upon termination:

  • Your right to access and use the Services immediately ceases
  • You must stop using the Services and uninstall the app
  • Your data will be deleted in accordance with our Privacy Policy
  • Active subscriptions may be canceled (subject to app store policies)
  • Sections of these Terms that by their nature should survive (warranties, disclaimers, limitations of liability, indemnification) will remain in effect

11. Disclaimers and Warranties

11.1 "AS IS" AND "AS AVAILABLE": THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

11.2 NO WARRANTIES: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties that the Services will meet your requirements or expectations
  • Warranties that the Services will be uninterrupted, timely, secure, or error-free
  • Warranties regarding the accuracy, completeness, or reliability of any content, information, or data
  • Warranties that defects will be corrected
  • Warranties regarding security or that your data will never be lost, stolen, or corrupted
  • Warranties that the Services are suitable for tracking allergies or managing health conditions

11.3 NO PROFESSIONAL ADVICE: WE DO NOT PROVIDE MEDICAL, HEALTH, NUTRITIONAL, OR PROFESSIONAL ADVICE. ANY CONTENT PROVIDED IS FOR INFORMATIONAL PURPOSES ONLY AND SHOULD NOT BE RELIED UPON FOR HEALTH DECISIONS.

11.4 THIRD-PARTY SERVICES: The Services may integrate with or depend on third-party services (cloud hosting, authentication, payment processing, analytics). We do not warrant or guarantee the availability, accuracy, or reliability of third-party services.

11.5 CONTENT ACCURACY: While we make reasonable efforts to provide accurate information, we do not guarantee the accuracy of nutritional data, allergen information, age recommendations, or any other content. Information may be outdated, incomplete, or incorrect.

11.6 AVAILABILITY: We do not guarantee that the Services will always be available or accessible. The Services may be interrupted, suspended, or terminated at any time due to maintenance, updates, technical issues, or other reasons beyond our control.

11.7 SOLE REMEDY: Your sole remedy for dissatisfaction with the Services is to stop using them.

11.8 Beta Features and Early Access

Pippin may be offered as a beta, early access, or preview version. Such versions are experimental and may contain bugs, errors, or incomplete features. Beta versions are provided "AS IS" with no warranties of any kind.

12. Limitation of Liability

12.1 MAXIMUM LIABILITY CAP: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO PIPPIN IN THE 12 MONTHS PRECEDING THE CLAIM.

12.2 NO LIABILITY FOR CERTAIN DAMAGES: TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, exemplary, or punitive damages
  • Loss of profits, revenue, business opportunities, goodwill, or reputation
  • Loss of data or information (ALWAYS MAINTAIN BACKUPS)
  • Cost of substitute goods or services
  • Any damages arising from your inability to use the Services
  • Damages caused by errors, inaccuracies, or omissions in content
  • Damages caused by unauthorized access to your data or account
  • Damages arising from third-party services or content
  • Any health-related injuries, allergic reactions, or adverse outcomes

WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12.3 NO LIABILITY FOR HEALTH OUTCOMES: WE ARE NOT LIABLE FOR ANY INJURY, ILLNESS, ALLERGIC REACTION, CHOKING, DEATH, OR OTHER ADVERSE HEALTH OUTCOME SUFFERED BY YOUR BABY OR ANY PERSON ARISING FROM:

  • Food introduction decisions made based on information from Pippin
  • Reliance on nutritional data, allergen information, or age recommendations
  • Failure to detect or prevent allergic reactions
  • Inaccurate, incomplete, or outdated information
  • Any use of or reliance on the Services

12.4 NO LIABILITY FOR DATA LOSS: We implement backup systems but do not guarantee your data will never be lost. YOU ARE SOLELY RESPONSIBLE FOR MAINTAINING BACKUP COPIES. We are not liable for any data loss, corruption, or destruction.

12.5 NO LIABILITY FOR THIRD PARTIES: We are not liable for:

  • Actions or omissions of third-party service providers (cloud hosting, analytics, payment processors)
  • Content or actions of other users (including caregivers you invite)
  • Third-party websites or services linked from Pippin

12.6 FORCE MAJEURE: We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, government actions, internet or network failures, or failures of third-party services.

12.7 ACKNOWLEDGMENT: THESE LIMITATIONS SHALL APPLY EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE. YOU ACKNOWLEDGE THAT THE LIMITATIONS IN THIS SECTION REFLECT A REASONABLE ALLOCATION OF RISK AND THAT PIPPIN WOULD NOT BE ABLE TO PROVIDE THE SERVICES WITHOUT THESE LIMITATIONS.

13. Indemnification

You agree to indemnify, defend, and hold harmless Pippin and its developers, affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

  • Your use or misuse of the Services
  • Your violation of these Terms or any applicable law or regulation
  • Your violation of any third-party rights, including intellectual property rights or privacy rights
  • Content you upload or submit to the Services
  • Any health decisions you make based on information from Pippin
  • Any unauthorized access to your account resulting from your failure to protect your credentials
  • Your invitation of caregivers and their actions within your baby's profiles

We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims.

14. Changes to the Services

We reserve the right to modify, suspend, or discontinue the Services (or any part thereof) at any time, with or without notice, for any reason. We may:

  • Add, modify, or remove features
  • Change pricing or subscription plans
  • Impose usage limits or restrictions
  • Discontinue support for certain devices or operating systems
  • Shut down the Services entirely

We are not liable to you or any third party for any modification, suspension, or discontinuation of the Services.

Note: As an early-stage application, significant changes or discontinuation are possible. We recommend maintaining external backups of important data.

15. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices, legal requirements, or service features.

15.1 Notification of Changes

When we make changes, we will:

  • Update the "Updated as of" date at the top of these Terms
  • Post the new Terms in the app and on our website
  • For material changes: notify you via email or in-app notification at least 30 days before the changes take effect

15.2 Your Options

If you do not agree to the updated Terms:

  • You must stop using the Services
  • You may delete your account before the changes take effect

Your continued use of the Services after the effective date of changes constitutes your acceptance of the updated Terms.

16. Governing Law and Dispute Resolution

16.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federative Republic of Brazil, including:

  • Brazilian Civil Code (Law No. 10.406/2002)
  • Brazilian Consumer Protection Code (CDC - Law No. 8.078/1990)
  • Brazilian General Data Protection Law (LGPD - Law No. 13.709/2018)
  • Brazilian Internet Framework (Marco Civil da Internet - Law No. 12.965/2014)

16.2 Jurisdiction

Any disputes arising out of or relating to these Terms or the Services shall be subject to the jurisdiction of the courts as determined by applicable law in your country of residence, or the courts of Brazil if you are not a consumer.

16.3 Consumer Rights

If you are a consumer, you may have additional rights under the consumer protection laws of your country of residence that cannot be waived by agreement. Nothing in these Terms limits your statutory consumer rights to the extent such limitations would be unenforceable under applicable law.

17. General Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or policies published by us, constitute the entire agreement between you and Pippin regarding your use of the Services and supersede any prior agreements.

17.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

17.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Pippin.

17.4 Assignment

You may not assign or transfer these Terms or your rights and obligations hereunder without our prior written consent. We may assign or transfer these Terms, in whole or in part, without restriction (including in connection with a merger, acquisition, or sale of assets).

17.5 No Third-Party Beneficiaries

These Terms are for the benefit of you and Pippin only. No third party has any right to enforce any provision of these Terms.

17.6 Relationship
